1. Agreement to Terms

These Terms of Service (the "Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and OmniDigitalM ("we," "us" or "our"), concerning your access to and use of our website and services.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access our services.

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
• If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

Additionally, you agree not to:

5. Payment Terms

We offer various paid services and packages. By selecting a paid service, you agree to pay us the applicable fees and taxes. If you fail to pay, we may suspend or terminate your access to our services.

Payment must be made using the methods we specify, and payment terms are as per the package or service you select. All fees are non-refundable unless expressly stated otherwise or required by applicable law.

We reserve the right to change our prices at any time. If we change pricing for a service you're already using, we will notify you at least 30 days before the change takes effect.

If you believe there's an error in the billing, please contact us within 60 days of the charge, and we will review your concern.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use our services will immediately cease. If you wish to terminate your account, you may simply discontinue using our services or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Disclaimer of Warranties

Our services are provided on an "AS IS" and "AS AVAILABLE" basis. OmniDigitalM and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement.

Neither OmniDigitalM nor its suppliers and licensors makes any warranty that our services will (i) meet your requirements, (ii) be available on an uninterrupted, timely, secure, or error-free basis, or (iii) be accurate, reliable, or completely secure.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall OmniDigitalM, or its suppliers or licensors, be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of our services, with the delay or inability to use our services, the provision of or failure to provide services, or for any information, software, products, services, and related content obtained through our services, or otherwise arising out of the use of our services, whether based on contract, tort, negligence, strict liability or otherwise, even if OmniDigitalM or any of its suppliers has been advised of the possibility of damages.

If you are dissatisfied with any portion of our services or with these terms of service, your sole and exclusive remedy is to discontinue using our services.

9. Indemnification

You agree to defend, indemnify, and hold harmless OmniDigitalM, its licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services, including, but not limited to, any use of our services' content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from our services.

10. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region of the People's Republic of China.

Any disputes relating to these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Hong Kong.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using our services.

12. Waiver and Severability

No waiver of by OmniDigitalM of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of OmniDigitalM to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

13. Entire Agreement

The Terms constitute the entire agreement between you and OmniDigitalM regarding your use of our services and supersede all prior and contemporaneous written or oral agreements between you and OmniDigitalM.

You may be subject to additional terms and conditions that apply when you use or purchase certain other services, affiliate services, third-party content, or third-party software.
